IM Chat User Content
(a) General. Through your use of the Services, you may have access to communication tools, including an instant chat function ("OKX Chat"), that allow you and other users to submit, post, or transmit data, text, images, or other materials (collectively, “User Content”). You understand that OKX does not control User Content and does not authorize, approve, pre-screen, verify, or endorse the completeness, legitimacy, legality, accuracy or reliability of any User Content. OKX expressly disclaims any liability arising from or related to such User Content. Your use of OKX Chat, and of any User Content, is at your own risk.
(b) Reservation of Rights. OKX reserves the right, in its sole and absolute discretion, to remove, suspend, or restrict your use of OKX Chat and/or any User Content. OKX reserves the right to report any User Content that it believes, in good faith, to be illegal, harmful, or otherwise in violation of applicable laws to the appropriate law enforcement authorities, regulatory agencies, or any other relevant authorities or parties.
(c) Grant of Usage Rights. By submitting User Content to the OKX platform, you grant OKX, its parent companies, affiliates, and service providers a perpetual, worldwide, non-exclusive, irrevocable, royalty-free, and fully paid-up right to host, store, use, display, reproduce, modify, and distribute such User Content for the operation, and improvement of our Services and of OKX Chat.
(d) User Compliance and Warranties. You represent and warrant that you possess all necessary intellectual property rights to any User Content you share. You agree that your User Content will not: (i) be defamatory, obscene, or unlawful; (ii) infringe upon the patents, trademarks, or copyrights of any third party; or (iii) contain software viruses or malicious code. You are solely liable for any damage resulting from any infringement of copyrights or any other harm resulting from your submission of User Content. OKX reserves the right to terminate access to OKX Chat or to our Services for users who repeatedly infringe upon the rights of others. You agree to indemnify and hold OKX harmless from and against any and all claims, liabilities, or expenses arising out of or related to your User Content.
(e) Nature of RM/ARM Communications and no investment advice. Where you are allocated to an Exclusive Service Group and assigned a Relationship Manager ("RM") and/or Account Relationship Manager ("ARM"), you acknowledge and agree that the RM and ARM function solely as client relationship and support representatives. Their role is limited to providing operational assistance, platform guidance, and service-related information. No communication made by an RM or ARM, whether via OKX Chat or any other channel, constitutes investment advice, a recommendation to buy or sell any virtual asset, a trading strategy, or a guarantee of returns or capital preservation. You agree to conduct your own independent due diligence before making any financial decision.
(f) No Guarantee of Availability. OKX does not guarantee the continuous availability of the RM or ARM function. During non-working hours or periods of unavailability, you will be directed to OKX's general customer support channels. OKX shall not be liable for any loss or damage arising from any delay in response or temporary unavailability of the RM or ARM function.
(g) Variable Nature of Service. The allocation of an RM or ARM to your account is made at OKX's sole discretion and may be modified, suspended, or discontinued at any time without prior notice. OKX does not represent that the level of service provided through the Exclusive Service Group will remain constant or that any particular RM or ARM will remain assigned to your account.
(h) Recording and Monitoring of Communications. You acknowledge and consent that all communications exchanged via OKX Chat, including those with your assigned RM or ARM, may be recorded, stored, monitored, and reviewed by OKX for purposes including regulatory compliance, quality assurance, dispute resolution, and legal obligations. Such records may be disclosed to regulatory authorities, including the Banco Central do Brasil and other competent authorities, upon lawful request. Retention of such records shall be governed by OKX's Privacy Policy and applicable law.
(i) Data Protection. By communicating via OKX Chat, including with your assigned RM or ARM, you acknowledge that OKX will process your personal data in accordance with its Privacy Policy and applicable data protection legislation, including, where applicable, the Brazilian Lei Geral de Proteção de Dados (Law 13.709/2018). You may exercise your data subject rights at any time by contacting OKX through the channels specified in the Privacy Policy. Personal data exchanged in the course of RM or ARM communications will be processed only for the purposes of service delivery, regulatory compliance, and legitimate operational needs.
(j) Complaint Handling. If you believe that any communication received from an RM or ARM is inaccurate, misleading, or otherwise unsatisfactory, you agree to submit a formal complaint through OKX's official complaint handling channel. You acknowledge that informal communications with an RM or ARM do not constitute a formal complaint submission and will not trigger OKX's complaint handling obligations. OKX is committed to addressing all formally submitted complaints in accordance with applicable regulatory requirements.
(k) Consumer Protection. Nothing in these Terms limits or excludes any rights you may have as a consumer under applicable mandatory consumer protection legislation in your jurisdiction of residence that cannot be waived by contract.
